These Terms of Service ("Terms") govern your use of the ShieldWave mobile application and related services (the "Service") provided by INNOFUN DIGITAL ENTERTAINMENT LLC ("Company", "we", "our", or "us"). By using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using ShieldWave, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Service Description

ShieldWave provides a Virtual Private Network (VPN) service that encrypts your internet connection and routes your traffic through Cloudflare's global anycast edge network. The Service includes:

3. Eligibility

You must be at least 13 years of age (or the applicable minimum age in your jurisdiction) to use the Service. By using ShieldWave, you represent and warrant that you meet this age requirement.

If you use Sign in with Apple or Google Sign-In, your authentication is governed by Apple's or Google's terms respectively. We only receive the information you authorise through those services (typically an email address and unique identifier).

5. Subscription and Payment

5.1 Free and Paid Plans

ShieldWave offers a Free plan and Pro subscription plans (Monthly and Annual):

Quota allowances, throttle rates, device limits, ad reward amounts, regional availability, and prices may be adjusted at our discretion with reasonable advance notice. Material changes will be communicated in the app and reflected on this page.

5.2 In-App Purchases

Subscriptions are processed through Apple App Store or Google Play Store. All billing, payment processing, and refunds are governed by the respective platform's terms:

5.3 Auto-Renewal

Paid subscriptions automatically renew at the end of each billing period (monthly or annual) at the same price, unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation takes effect at the end of the current paid period. No refunds are given for unused time within a billing period, except where required by applicable law or platform policy.

WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT IT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INNOFUN DIGITAL ENTERTAINMENT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless INNOFUN DIGITAL ENTERTAINMENT LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Nassau County, New York.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the app or posted on this page. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

14. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.
